Since Regulation (EU) 2018/395, ballooning has its own rules in Part-BOP and its own licensing in BFCL, separate from the general air operations framework. Commercial passenger flights add a declaration and a set of additional requirements on top of the basic ones.
Most balloon operators are small businesses without a compliance department. The rule you fly under still has to be the current one, and the authority will ask which version your procedures were written against.
Commercial passenger flights bring the BOP.ADD subpart with them, and the two sets read alike.
Part-BOP governs the flight, BFCL the licence, and one question often touches both.
